Terms and conditions
1. General
The operator of the mobile applications "La Liguilla" ("App or the Apps") is La Liguilla KG, Flotowgasse 26/3/4, 1190 Vienna (hereinafter referred to as "La Liguilla").
La Liguilla allows mobile application users to consume and share various media-based sports news in a simple and straightforward manner. Such multimedia materials are stored by various platforms (e.g. YouTube, Vimeo, Dailymotion) or on La Liguilla directly. The applications are made available to users of different mobile end devices (e.g. iOS, Android) or through the web application and can currently be used worldwide in various languages in a fast and user-friendly manner. As a sports community, La Liguilla offers a platform that allows fans to follow their favorite teams and share news with friends, features sports news, live scores, videos and other functions on a variety of channels.
2. Scope
These terms and conditions apply to all La Liguilla applications. Both mobile and for the web, including all online services, content, features and offers within the apps on the offered operating systems (iOS, Android). By using the La Liguilla apps, the user accepts the validity of the terms and conditions and agrees to them. They should therefore be read carefully.
Terms and conditions apply to both consumers and businesses. They are always available online and applicable to all services, unless specific rules apply to a particular service. In case of disagreement with these terms and conditions, a complaint must be made expressly in writing.
La Liguilla reserves the right to modify its Terms of Use and Privacy Policy when it deems appropriate. The user is obliged to review the content of these Terms of Use and Privacy Policy, as they may be modified without prior notice. Likewise, you understand and accept each and every one of the clauses contained in this document. It is the sole responsibility of the User to periodically review the terms and conditions.
3. Contract
This contract refers to the free and free of charge use of the La Liguilla applications.
The contractual relationship between the user and La Liguilla becomes effective by clicking on the "install" button on the product description page, or in the respective app stores
La Liguilla's service is intended for users over 12 years of age; those under 18 years of age require the consent of their parents or guardians.
The free version of the applications displays advertising in the form of banners, full screen or sponsor logos, and may need to be closed by clicking a checkbox to return to the application. App users will not be able to edit, remove or hide ads.
La Liguilla reserves the right to stop providing free services at any time and without prior notice. In this case, the user will not have the right to claim the continuation of the service.
La Liguilla reserves the right to extend, modify or delete services or to make improvements, especially if these help technical progress, are truly necessary or to prevent abuse. Changes may alter the appearance, design, navigation or features of the applications. In this case La Liguilla makes every effort to maintain the simplicity of use.
Both users and La Liguilla may terminate this agreement immediately at any time and for any reason. In this case, the user would no longer be bound by these terms and conditions. The termination of the contract will be effective immediately upon deletion of the application from the mobile device.
4. Registration and use of La Liguilla applications
La Liguilla offers a registration via a Facebook account. For a registration via email address, the user has to also specify the other required data truthfully and completely.
La Liguilla will inform you in advance in case of any internal maintenance, or of the applications, which interferes with the functioning of the services. La Liguilla is not responsible for downtime caused by lack of internet connection and especially for downtime in which an application is unavailable due to technical or other problems.
5. Rules of the game
The user is solely responsible for the data, images and content provided by the user. La Liguilla is not obliged to check these files for viruses.
It is absolutely prohibited to post or upload content that reflects violence, pornography, racial discrimination, abuse or defamation. Images depicting persons other than the user should only be uploaded if you have the permission of that person(s).
Content provided by La Liguilla in its applications (e.g. news, photographs, etc.) must not be copied, distributed or made available to the public without the permission of the copyright holder - unless permitted by law.
Attacks on the functionality of the La Liguilla applications, such as mass e-mailing (SPAM), hacker attacks, brute force attacks, the use or delivery of spyware, viruses and/or malware, are strictly prohibited.
If you violate these rules, La Liguilla shall have the right to warn you, temporarily block your account, and even completely suspend your use of the application, as well as assist law enforcement for criminal liability. Failure or delay in taking such actions does not constitute a waiver of the rights to enforce these terms. La Liguilla is not obligated to provide prior notice or notice of removal of content or termination of a user account.
La Liguilla assumes no responsibility for the texts of its users or any other user, insofar as they contain content, images, data or linked external websites. In particular, La Liguilla does not guarantee that this information is true or fulfills a specific purpose.
6. Indemnification
The user shall hold La Liguilla harmless from all claims, including claims for damages suffered by other users or third parties (including public authorities), for a violation of third party rights caused by content posted on the application. The user covers all reasonable costs, including legal defense costs arising for La Liguilla due to a violation of third party rights caused by the user. All other rights, including claims for damages by La Liguilla shall remain unaffected.
The above obligations shall only apply to the extent that you are responsible for the breach, acted knowingly or intentionally, or failed to exercise reasonable care.
The user shall take appropriate measures to secure his uploaded and stored data and create his own backup copies for his own reconstruction of this information in case of loss.
It is not technically possible for La Liguilla to determine with certainty whether a registered user actually has the identity he or she purports to have. La Liguilla cannot assume any responsibility for the correct identity of users.
7. Responsibility for the content and functionality of the applications
La Liguilla provides various multimedia content within the offered applications. The content provided may also contain third-party copyrighted content. Such content does not belong to La Liguilla and there is no possibility to change or edit it. La Liguilla assumes no responsibility for the accuracy, legality, completeness and timeliness of the contributions, in particular for this content and information from third parties, which are referred to through links in the application. Therefore, La Liguilla is not liable for damages caused by third party content, such as copyright infringement or other.
Third-party data available in the application and content are not stored or hosted by La Liguilla. The respective third-party content is only stored on the respective hosting platforms (e.g. Youtube, ... ). La Liguilla has no influence on the scope and period of storage and availability of any third-party content or media material.
Users of the applications do not have the right to demand access to certain content or the availability of certain functions that are not implemented in La Liguilla.
La Liguilla is not obliged to improve, update the Applications or make content and features available in the respective Application. La Liguilla does not guarantee certain functionality.
8. Responsibility
La Liguilla is liable only for intent and gross negligence, including intent or gross negligence of its representatives or agents. In case of slight negligence, La Liguilla shall only be liable:
In case of culpable injury to life, body or health
In case of breach of an essential contractual obligation (a duty, the fulfillment of which makes the cancellation of the contract and the proper use of the applications possible and on whose observance the user usually relies). The claim for damages is then limited to the foreseeable damage that normally occurs.
The above limitations do not apply if La Liguilla fraudulently conceals a circumstance with respect to the standard of the applications. The same applies to any claim by the user under the Product Liability Act.
9. Revocation of the contract
General - Right of revocation
You have the right to revoke this contract within fourteen days without providing a reason. The revocation period is fourteen days from the date of conclusion of the contract. To exercise your right of cancellation, you must inform La Liguilla (by e-mail) about your decision to revoke this contract, with a clear explanation. Special note: Your right of revocation expires prematurely for contracts for the supply of digital content (such as the app) that are not stored on a tangible medium when La Liguilla starts with the execution of the contract before the end of the revocation period after you explicitly agree and confirm that you will lose your right of revocation with the start of the execution of the contract.
10. Privacy Policy
By using La Liguilla, the privacy statement of La Liguilla applies and forms part of these terms and conditions.
11. Final provisions
The possible invalidity of one or more provisions of these terms and conditions shall not invalidate the remaining provisions. Any use of La Liguilla applications or data, information, texts, text parts or images contained herein, and any action, tolerance or omission in connection with the use thereof, is exclusively subject to Austrian law. This also applies to the use or registration of users from other countries. Jurisdiction is determined by the location of La Liguilla (Vienna, Austria).
